The H-1B is the US's central employer-sponsored work visa for foreign professionals in 'specialty occupations' requiring at least a US bachelor's degree (or foreign equivalent) in a directly related specialty. Employer files an approved DOL Labor Condition Application (LCA, ETA-9035) and pays the OES prevailing wage at Level I–IV. Annual cap: 65,000 + 20,000 master's-cap (US master's or higher); FY2026 cap already reached. Dual intent is permitted. Premium processing: 15 business days, $2,805 (effective 1 March 2026). Initial stay up to 3 years; max 6 years (extendable under AC21 if green-card process is pending).
